METER ASSET PROVIDER REGULATION 2018: FRAMEWORK TO CLOSE THE METERING GAP IN THE NIGERIAN ELECTRICITY SUPPLY INDUSTRY

The Nigerian Electricity Regulatory Commission (“NERC” or the “Commission”) in exercise of the powers conferred on it by Section 96 of the Electric Power Sector Reform Act 2005 (“the EPSRA”) has introduced the Meter Asset Provider Regulation 2018 (“the MAP Regulation”). The key regulatory objective of the Commission, is to provide standard rules to encourage the development of independent and competitive metering services within the Nigerian Electricity Supply Industry (NESI). Prior to the regulation, the obligation of metering electricity customers was the statutory responsibility of the Distribution Licensees (“Discos”), who perhaps due to liquidity challenges within the NESI were unable to finance the acquisition and installation of meters.

THE NON-GOVERNMENTAL ORGANIZATIONS REGULATORY BILL

The Non-Governmental Organizations Regulatory Commission (Establishment) Bill, 2016 (“the Bill”), is one the 1716 bills currently pending in the 8th National Assembly. The Bill seeks to provide for the establishment of a Non-Governmental Organizations Regulatory Commission of Nigeria (“the Commission”) for the supervision, co-ordination and monitoring of Non-Governmental Organizations (NGO), Civil Society Organizations (CSO), and Community Based Organizations (CBO).

Upon presentation, the Bill was met with disquiet by individuals and organizations within and outside Nigeria, with concerns that the said bill will constrain the operations of NGO’s, and impede on the rights of peaceful assembly within the Country.
